Xigen is not an emergency-dispatch service. Xigen helps you notify people you have chosen to trust. It does not replace 911 or your local emergency number, and it does not guarantee that any alert, message, call, or location will be delivered or that assistance will arrive. If you believe you need immediate professional help, contact emergency services directly.

1. Acceptance of these terms

By creating an account or using the Xigen mobile application ("Xigen," "the App," "we," "us"), a product of DGZ Studios operated by Trexbusiness Solutions LLC, you agree to these Terms & Conditions and to our Privacy Policy. If you do not agree, do not use the App.

2. Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an Xigen account. By creating an account, you represent that you meet this requirement and that the information you provide is accurate.

3. What Xigen does — and its limits

Xigen lets you send alerts to trusted contacts you designate, share your current or last-known location, and activate on-device emergency tools.
Delivery of alerts, SMS messages, push notifications, calls, and location data depends on your device, network connectivity, permissions you have granted, GPS availability, and the continued operation of third-party services (including your mobile carrier, Google Firebase, and Amazon Web Services). None of these are guaranteed.
Location shared through Xigen may be delayed, approximate, or based on a last-known position rather than your current location.
A trusted contact's acknowledgment or response inside Xigen does not confirm that emergency services have been contacted or that help is on its way — only a contact's own explicit report of calling 911 reflects that, and even that report is not verified by Xigen.
Self-entered medical information in your profile is not verified by Xigen and should not replace professional medical identification, testing, or records.
If you opt in to silent evidence capture, Xigen captures a photo and, where permitted, a short audio clip periodically during a real SOS activation. Audio capture availability depends on your device's location and applicable state consent law, and is automatically disabled where two-party consent is required — Xigen does not evaluate whether recording is lawful in every circumstance, only the general state-law gate described above, and you remain responsible for complying with applicable law.

4. Your responsibilities

Keep your trusted-contact list, medical profile, and account information accurate and current.
Obtain any necessary consent before adding a person as a trusted contact.
Do not use Xigen to send false alerts, harass any person, or otherwise misuse the emergency-alert or messaging features. We may suspend or terminate accounts that abuse these features.
You are responsible for maintaining the security of your account credentials.

5. SMS & messaging terms

By adding a trusted contact, you confirm you have their permission to share their phone number with us so they may receive SMS alerts related to your account. Message frequency varies and is tied only to emergency activations and alerts you explicitly test. Message and data rates may apply. Reply STOP to a Xigen text to opt that number out of future messages, or HELP for support. Carriers are not liable for delayed or undelivered messages.

6. Subscriptions & billing

Xigen offers a free tier and a paid Premium subscription (Individual and Family plans), billed through Google Play, with an initial free trial period as disclosed at purchase. Subscriptions renew automatically at the price shown at the time of purchase unless canceled before the renewal date through Google Play. You can manage or cancel your subscription at any time from Google Play's subscription settings. Core safety features — including one-tap SOS activation, calling 911, the on-device flashlight and alarm, up to two trusted contacts, one location-sharing SMS, and basic medical information — remain available on the free tier after a trial or subscription ends.

7. Third-party services

Xigen relies on third-party infrastructure, including Google Firebase (authentication, data storage, push notifications) and Amazon Web Services (SMS delivery). Your use of Xigen is also subject to the acceptable-use terms of those providers where applicable.

8. Disclaimer of warranties

Xigen is provided "as is" and "as available," without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that any alert will be successfully delivered or acted upon.

9. Limitation of liability

To the maximum extent permitted by law, Trexbusiness Solutions LLC and its officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of life, personal injury, or property damage, arising from or related to your use of, or inability to use, Xigen — including any failure or delay in the delivery of an alert, message, call, or location.

10. Termination

You may stop using Xigen and delete your account at any time from within the App. We may suspend or terminate accounts that violate these terms, including for abuse of the alert or messaging features.

11. Changes to these terms

We may update these Terms from time to time. Continued use of Xigen after an update constitutes acceptance of the revised terms. Material changes will be notified in-app where practical.

12. Governing law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to its conflict-of-law principles, unless otherwise required by applicable local law in your jurisdiction.
