This End User License Agreement ("EULA") is a legal agreement between you and Trexbusiness Solutions LLC ("we," "us"), operator of the Xigen mobile application ("the App") under the DGZ Studios brand. It supplements, and should be read alongside, our Terms & Conditions and Privacy Policy.
Subject to your compliance with this EULA, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on devices you own or control, solely for your personal, non-commercial use.
You may not: (a) copy, modify, or create derivative works of the App; (b) reverse-engineer, decompile, or disassemble the App except as permitted by law; (c) rent, lease, sell, sublicense, or otherwise transfer the App to a third party; (d) remove or obscure any proprietary notices; or (e) use the App in any way that violates applicable law or these terms.
The App, including its design, text, graphics, logos, and underlying software, is owned by Trexbusiness Solutions LLC and its licensors and is protected by copyright, trademark, and other intellectual property laws. This EULA does not grant you any ownership rights in the App.
You retain ownership of the information you enter into the App, such as your medical profile and trusted-contact list. You grant us a limited license to use that information solely to operate the App's features, as described in our Privacy Policy.
We may release updates to the App to add features, improve reliability, or address security issues. Some updates may be required to continue using the App.
The App relies on third-party services, including Google Firebase and Amazon Web Services, to operate. Your use of those underlying services through the App is also subject to their own terms where applicable.
The App is provided "as is," without warranty of any kind, express or implied. We do not warrant that the App will be error-free, uninterrupted, or that any emergency alert, message, or location will be successfully delivered. See our Terms & Conditions for important safety disclaimers.
To the maximum extent permitted by law, Trexbusiness Solutions LLC will not be liable for any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, the App.
This license is effective until terminated. It will terminate automatically if you fail to comply with any provision of this EULA, or when you delete the App and your account. Upon termination, you must stop using the App.
This EULA is governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to its conflict-of-law principles, unless otherwise required by applicable local law in your jurisdiction.
